By accessing or using the RadHub platform, website, or associated services, you agree to be bound by these Terms and Conditions.
If you do not agree with any part of these Terms, you should not use the RadHub platform.
2. Platform Provider
RadHub is a healthcare technology platform operated by Medscape (Pty) Ltd.
The platform provides software solutions, digital tools, and system integrations used by healthcare providers to manage practice operations, patient communication, and administrative workflows.
RadHub does not provide medical services.
3. Services Provided
RadHub provides software services that may include:
- Healthcare workflow management tools
- Patient communication portals
- Document management systems
- Reporting and analytics tools
- System integrations with healthcare systems
- Technical support and software maintenance
Specific services, deliverables, and service levels may be defined in separate service agreements with healthcare providers.
4. Healthcare Providers Using the Platform
Healthcare providers using the RadHub platform remain responsible for:
- the collection of patient information
- compliance with healthcare regulations
- obtaining patient consent where required
- maintaining clinical records
- complying with the Protection of Personal Information Act (POPIA)
RadHub provides the technology platform only and does not determine how healthcare providers manage patient data.
5. User Responsibilities
Users of the RadHub platform agree to:
- provide accurate information when required
- maintain the confidentiality of login credentials
- use the platform in accordance with applicable laws
- not misuse the platform or attempt to gain unauthorized access
- respect the intellectual property rights of the platform
Users are responsible for any activity conducted through their account.
6. Intellectual Property
All technology, software, systems, documentation, and platform infrastructure relating to RadHub remain the intellectual property of Medscape (Pty) Ltd.
Healthcare providers are granted a license to use the platform under agreed service terms.
Use of the platform does not grant ownership of the underlying software or technology.
7. Data Protection
RadHub implements appropriate technical and organisational safeguards designed to protect data processed through the platform.
However:
- Healthcare providers remain responsible for the lawful processing of patient information.
- Healthcare providers are responsible for obtaining appropriate patient consent.
- RadHub acts as a technology provider and operator processing information on behalf of healthcare providers.
8. System Availability
RadHub aims to maintain reliable system availability and performance.
However, the platform may occasionally be unavailable due to:
- maintenance or updates
- system upgrades
- technical issues beyond our control
- external service interruptions
RadHub does not guarantee uninterrupted service availability.
9. Payment Terms
Where applicable, subscription fees, licensing fees, or service charges will be specified in separate service agreements.
Failure to comply with payment obligations may result in:
- suspension of services
- restriction of platform access
- termination of service agreements
10. Confidentiality
Both parties agree to maintain confidentiality regarding:
- proprietary information
- technical systems
- business processes
- commercial information
This obligation continues even after termination of services.
11. Limitation of Liability
To the fullest extent permitted by law:
- Medscape (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages arising from the use of the RadHub platform.
- RadHub provides software services only and does not assume responsibility for clinical decisions, medical outcomes, or healthcare services provided by healthcare professionals using the platform.
12. Suspension or Termination of Services
RadHub may suspend or terminate access to services where:
- terms of use are violated
- unlawful activity is detected
- payment obligations are not met
- security risks are identified
Healthcare providers may terminate services in accordance with the terms of their service agreement.
13. Changes to Services
RadHub may update or modify features, services, or functionality to improve the platform.
Where material changes occur, reasonable notice will be provided.
14. Governing Law
These Terms and Conditions are governed by the laws of South Africa.
Any disputes arising from the use of the platform shall be subject to the jurisdiction of South African courts.
15. Changes to These Terms
These Terms and Conditions may be updated from time to time.
Continued use of the RadHub platform constitutes acceptance of any updated Terms.
